1. About these Terms

These Terms of Use ("Terms") govern your access to and use of theluxuryworld.com and any information, property materials, enquiry services or other content made available through the website.

By using the website, you agree to these Terms. If you do not agree, please do not use the website. Our Privacy Policy and Cookie Policy also apply to your use of the website.

The Luxury World Ltd ("TLW", "we", "us" or "our") operates as a property introduction and marketing platform. We market selected properties and developments and may introduce prospective buyers to developers, property owners, authorised sales representatives and professional service providers.

TLW is not, merely by operating this website, the developer, owner or seller of any property. Unless expressly agreed in a separate written contract, TLW does not act as your lawyer, tax adviser, immigration adviser, financial adviser, investment manager, lender or regulated foreign exchange provider.

3. Information only; no offer or contract

Website content is provided for general information and marketing purposes. It does not constitute an offer capable of acceptance, a reservation, a sale and purchase agreement, a guarantee of availability or a binding commitment by TLW, a developer or a property owner.

A property transaction will be subject to separate written documentation, due diligence, eligibility requirements, payment conditions, governmental or regulatory approvals and the terms imposed by the relevant seller, developer and professional advisers.

4. Property information and availability

We take reasonable care when presenting property information, but details may originate from developers, owners or other authorised sources and may change without notice.

Unless confirmed in a binding written contract:

  • prices, availability, incentives, payment schedules and completion dates are subject to confirmation;
  • dimensions, areas and distances may be approximate;
  • plans, layouts, specifications, finishes, furniture, landscaping and amenities may change;
  • computer-generated images, renders, photographs and videos may be illustrative;
  • views shown may depend on the exact unit, floor, orientation, landscaping and future development;
  • availability shown online may not reflect a reservation or sale completed shortly before the website is updated;
  • references to rental potential, investment appeal, capital appreciation or lifestyle benefits are not guarantees.

You must verify all material information with the relevant seller or developer and through your independent professional advisers before committing to a purchase.

5. Prices and currency conversions

The official property price is the price stated in the sale currency for the relevant listing, subject to confirmation by the developer or seller. Where the official price is stated in Mauritian rupees (MUR), any EUR or USD equivalent displayed by TLW is indicative only.

Indicative conversions may be calculated using periodically reviewed reference rates and rounded for readability. They are not live quotes, do not fix an exchange rate, and may differ from the amount available through a bank or foreign exchange provider. The official sale currency and payment obligations stated by the seller remain controlling.

Taxes, duties, registration fees, professional fees, bank charges, foreign exchange costs and other transaction expenses may not be included unless expressly stated.

6. International property payments and FX introductions

TLW may introduce an international buyer to a chosen specialist foreign exchange provider. The provider, not TLW, is responsible for any regulated foreign exchange service, customer due diligence, rate quotation, payment instruction, execution and client agreement.

References to preferential rates or potential savings are general marketing statements only. Actual rates and savings depend on currency pair, amount, timing, market conditions, provider pricing, bank charges and customer circumstances. Savings are not guaranteed.

You should review the provider's terms, regulatory status, fees, privacy notice and payment instructions before using its services. TLW is not responsible for exchange-rate movement, banking delays, rejected payments, fraud arising from instructions not verified through an approved channel, or the acts or omissions of an independent provider, except to the extent liability cannot lawfully be excluded.

7. No legal, tax, immigration, investment or financial advice

Website content and communications from TLW do not constitute legal, conveyancing, notarial, tax, immigration, residency, investment, financial, mortgage or insurance advice.

Mauritian property ownership rules, foreign-buyer eligibility, residence rights, tax treatment and investment outcomes depend on personal circumstances and may change. You should obtain independent advice from appropriately qualified professionals before making a decision.

8. Enquiries and introductions

Submitting an enquiry does not create an agency, fiduciary, advisory or contractual relationship and does not reserve a property. You confirm that information you provide is accurate, lawful and not misleading and that you are authorised to provide it.

Where requested or relevant, we may pass your enquiry to a developer, owner, authorised representative or professional partner. That party may contact you directly and may apply its own terms and privacy notice.

9. Marketing communications

Where you have subscribed or where otherwise permitted, TLW may send property alerts, newsletters, market updates and promotional communications. You may unsubscribe at any time. Marketing preferences and retargeting technologies are also addressed in our Privacy Policy and Cookie Policy.

10. Intellectual property

The website and its content, including text, branding, design, graphics, layout, photographs, video, databases, software and compilations, are owned by TLW, licensed to TLW, or used with permission and are protected by applicable intellectual property laws.

You may view and print reasonable extracts for personal, non-commercial property research. You must not, without prior written permission:

  • copy, reproduce, republish, distribute, sell, license or commercially exploit website content;
  • remove copyright, trademark or attribution notices;
  • use photographs, plans, brochures or property data in another listing or marketing service;
  • scrape, crawl, harvest or systematically extract content or data;
  • frame or mirror the website or create a derivative database;
  • use TLW branding, domain names or confusingly similar marks.

11. Acceptable use

You must not:

  • use the website unlawfully, fraudulently or to infringe another person's rights;
  • submit malicious code, spam, false enquiries or automated form submissions;
  • attempt to gain unauthorised access to the website, hosting, data or accounts;
  • interfere with security, availability, performance or normal operation;
  • impersonate another person or misrepresent your authority or intentions;
  • use the website to conduct unlawful financial activity or circumvent sanctions, anti-money-laundering or eligibility requirements.

We may restrict access, block submissions or take other reasonable action where we suspect misuse or a security risk.

13. Website availability and security

We aim to keep the website available and accurate but do not guarantee uninterrupted, error-free or secure operation. We may suspend, withdraw, change or restrict any part of the website for maintenance, security, legal, commercial or technical reasons.

You are responsible for using appropriate security controls and for independently verifying payment or bank-detail instructions through a trusted channel. TLW will never be responsible for a payment made to an account that has not been properly verified, except where liability cannot lawfully be excluded.

14. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation and any other liability that applicable law requires us to retain.

Subject to that principle, TLW is not liable for a decision made solely in reliance on general website content; changes to availability, price, specification or law; acts or omissions of a developer, seller, owner, professional adviser, bank, foreign exchange provider or other independent third party; exchange-rate movement; or indirect, consequential or purely economic loss that was not reasonably foreseeable.

Where applicable law allows a limitation, TLW's total liability arising from free access to the website will not exceed the greater of MUR 10,000 or the amount, if any, paid directly to TLW for the specific website service giving rise to the claim. This limitation does not apply where it would be unlawful or unreasonable to do so.

Different or additional liability terms may apply under a separate written agreement for paid services.

15. Indemnity for misuse

To the extent permitted by law, you agree to reimburse TLW for reasonable losses, liabilities and costs arising directly from your unlawful misuse of the website, infringement of intellectual property rights, malicious interference with the website, or submission of content that you were not entitled to provide.

16. Changes to the website and these Terms

We may update the website and these Terms from time to time. The current version will be published with an updated date. Continued use after an update means the revised Terms apply from the date they take effect.

17. Severability and waiver

If a provision is found unlawful or unenforceable, it will be adjusted or severed to the minimum extent necessary, and the remaining provisions will continue. A delay or failure to enforce a right is not a waiver of that right.

18. Assignment

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations as part of a genuine business reorganisation, financing, sale or transfer, provided that this does not reduce mandatory protections available to you.

19. Governing law and jurisdiction

These Terms and any non-contractual dispute connected with them are governed by the laws of Mauritius. The courts of Mauritius will have jurisdiction, subject to any mandatory consumer rights or jurisdiction rules that apply in the country where you ordinarily reside.
